Terms of use of autoszczech.ch

Rules for using the service and participating in vehicle auctions.

These Terms define the rules for using the Service and the conditions for participating in vehicle auctions.

§1. General information

The owner and operator of the autoszczech.ch website (the “Service”) is:

JACEK SZCZĘCHFIRMA HANDLOWO – USŁUGOWA AUTO SZCZĘCH JACEK SZCZĘCHTax ID (NIP): 8261450580Business ID (REGON): 140317079address: Korytnica, ul. 52A, 08-455, Polande-mail: [email protected]

hereinafter referred to as the “Operator”.

A User of the Service may be any natural or legal person who has created a user account, read the Terms and Privacy Policy, and accepted their content.

Information published in the Service is provided solely for informational purposes and does not constitute a commercial offer within the meaning of the Polish Civil Code or other applicable law.

§2. Nature of the Service

The Service is a platform providing access to auctions of vehicles, parts and other automotive-related items.

The Operator is neither a vehicle manufacturer nor an insurer and is not liable for the technical condition of vehicles.

The User makes purchasing decisions at their own risk.

Vehicle descriptions and photographs are provided by third parties, and the Operator is not liable for possible inaccuracies or errors in their content.

§3. Participation in auctions

Each auction has an individual identification number. Through the Service, the User indicates the auction item and the offered price, and the Operator submits the offer on the User’s behalf in the relevant auction.

Submitted offers are binding and cannot be withdrawn.

The bidding conducted in the Service is a local sealed-bid process used by the Operator to select the User represented by the Operator in the external auction.

  • Users can see only their own bids, while the Operator can see all bids in order to operate the auction;
  • bids are placed in PLN and cover only the price of the car, excluding transport, commission, taxes and other additional costs;
  • a User may increase their bid until the auction ends but may not reduce or withdraw it;
  • the auction ends at the time shown in the Service and is not extended;
  • the highest correctly recorded bid wins; if amounts are equal, the bid recorded earlier takes priority.

Winning the local bidding does not yet mean that the vehicle has been purchased. Final fulfilment depends on the result of the external auction and the seller’s decision.

The User remains bound by the bid until the final decision is communicated, but for no longer than 30 business days after the auction ends.

§4. Auction result and award of the item

The User is informed of the auction result after it ends.

The entity organising the auction may finally award the vehicle within up to 30 business days.

The auction organiser may repeat the auction procedure or reconsider submitted offers.

Auctions marked as Allianz may be subject to separate rules for communicating the result.

§5. Payments and fulfilment

After the item is awarded, the Operator provides the User with payment information.

The Service does not process payments for vehicles. The Operator contacts the User individually and provides the method, currency, amount and details required for settlement.

The User undertakes to pay the amount due within 5 business days after receiving the payment information.

The vehicle and documents are released after all financial obligations have been fulfilled.

§6. Contractual penalties

If payment is delayed, the Operator may charge a parking fee of CHF 30 for each day of delay.

Failure to pay for an awarded vehicle results in an obligation to pay a contractual penalty equal to 20% of the offered amount, but not less than CHF 2,000.

Failure to pay for and collect the item may result in deletion of the user account and blocking of further access to the Service.

§7. Release and technical condition of the vehicle

The vehicle is released at the address indicated by the User or at the Operator’s premises.

The auction organiser is not liable for differences in the vehicle’s condition between presentation and collection.

Additional items and movable equipment are not part of the auction item.

The vehicle may be released with one set of keys.

§8. Dispute resolution

The parties undertake first to attempt an amicable resolution of any dispute.

If no agreement is reached, disputes will be decided by the court having jurisdiction over the Operator’s registered office.

§9. Final provisions

Registration in the Service constitutes acceptance of these Terms.

The Operator reserves the right to amend the Terms.

The current version of the Terms is published in the autoszczech.ch Service.

The Terms take effect on the date of their publication.
